Tomorrow, Tues, April 15, at 4:00 PM ET, Judge #Xinis will be hearing a “Status Conference” on #KilmarAbregoGarcia et al v. Noem et al.

It’ll be interesting to hear how she responds to the #Trump admin’s latest filing. She has been very plainspoken in her assessment of the #DOJ’s claims.

During ordinary times, this accommodation would reflect an appropriate respect for the constitutional #SeparationOfPowers. In dealing with this Administration, with its maximalist conception of executive authority & its contemptuous attitude toward the #judiciary, the Justices are being played for fools.

That, the govt argued, would intrude on the President’s sole power to conduct foreign relations. So the govt’s responsibility here is to, what, maybe issue #AbregoGarcia a Global Entry card to cut the #immigration line if he somehow turns up at a #US airport? This defiant position cannot stand—not if the rule of #law is to survive.

Aaron Reichlin-Melnick has handily outlined #KilmarAbregoGarcia’s legal #immigration history to show that no matter how many times #Trump & his thugs say it, there is no proof #AbregoGarcia is or ever was a M-13 gang member.

The admin has appealed the order from last week that required it to readmit the #AP’s journalists, but a court of appeals hearing the case has not intervened so far. Although the pool for #Trump’s events today was planned & distributed to media outlets yesterday—before the order had taken effect—the absence of any AP journalists today or in coming days would be in violation of a judge’s order, unless the appeals court grants an emergency stay.

In 2019, an #immigration judge had barred the #US from deporting #KilmarAbregoGarcia by finding that he might face violence or torture if sent to #ElSalvador. That did not stop #Trump from deporting him & scores of other migrants to #ElSalvador last month.

In a legal filing on Sunday, the #DOJ argued that the courts lacked the ability to dictate steps the White House should take to return the man, #KilmarAbregoGarcia, because only the president had the power to handle US foreign policy.

The #Trump admin has fought against returning Abrego Garcia, a 29-yr-old father of 3, despite admitting in court that his removal was an “administrative error.”

The removal of the migrants to the prison, known as #CECOT, has become a flashpoint in the admin’s skirting of normal #immigration practice & the role of the #courts in reviewing #Trump’s #ExecutivePower.

Just a day before the meeting between the 2 leaders, the Trump admin once again defied a federal judge’s order to bring back a Maryland man who was unlawfully deported to the prison.

"It is my understanding based on official reporting from our Embassy in San Salvador that Abrego Garcia is currently being held in the Terrorism Confinement Center in El Salvador," it said. "He is alive and secure in that facility. He is detained pursuant to the sovereign, domestic authority of El Salvador."

The filing from Michael Kozak, of the #State Department's Bureau of Western Hemisphere Affairs, did not, however, say what steps the #Trump admin was taking to bring #KilmarAbregoGarcia home, as #Xinis had also ordered.

"I am aware that the instant lawsuit has been filed seeking the return of Kilmar Armando Abrego Garcia to the United States from El Salvador," Kozak's filing said.
