In a 5-4 ruling, the U.S. Supreme Court has thrown out the order of District Judge James Boasberg, who blocked removal of Venezuelans to El Salvador without legal process under the Alien Enemies Act. The government had previously indicated that deportations would immediately resume if Boasberg's order was lifted. Judge Ketanji Brown Jackson wrote in her dissent: "We are just as wrong now as we have been in the past, with similarly devastating consequences. It just seems we are now less willing to face it,” adding: "At least when the Court went off base in the past, it left a record so posterity could see how it went wrong,” citing the notorious ruling that allowed government confinement of Japanese Americans during World War II. #SCOTUS handed #Trump a victory on Monday by letting him use the #AlienEnemiesAct, a 1798 #law that has been employed only in wartime, to swiftly deport alleged Venezuelan *gang members* as part of Trump's extreme #immigration policies.

In the #Trump admin’s #SCOTUS application, it refers to Abrego Garcia as an “enemy alien.”

The government has claimed that Garcia was removed under the #Immigration & Nationality Act, NOT the #AlienEnemiesAct.

The Trump admin has also claimed he’s a member of M13 which is NOT covered by the #AEA, only Tren de Aragua.

The admin appealed Judge Xinis’s order to the US Court of Appeals for the Fourth Circuit, which on Mon declined to intervene immediately & stay the lower court ruling.

So the #Trump admin asked #SCOTUS to intervene on an emergency basis [I think we’re in double digits now for Trump’s SCOTUS emergency applications].

Abrego García has been detained at #CECOT, a mega-prison in #ElSalvador, since #ICE deported him last month, despite a court order forbidding it because he had fled death threats from gang members in his home country.

#Trump officials have argued that they have no power to return Abrego García because he is now in the custody of El Salvador. [even though the US is paying El Salvador to incarcerate him & others there]

#Trump asks #SCOTUS to help him break the #law, again.

Trump asked the #SupremeCourt to block a court order to return a deportee from #ElSalvador’s #CECOT that his admin admitted to deporting by mistake.

Judge Paula Xinis gave the Trump admin until midnight Monday to return #KilmarAbregoGarcía, who was deported despite a court order forbidding it.

The justices will soon decide whether to relieve the #Trump admin from the trial court’s order halting the expulsions. Whether the govt has complied w/the order isn’t directly before #SCOTUS. But whether the Court can trust the govt’s representations during such quickly unfolding litigation is—& the justices have every reason not to.

The #Trump admin had asked #SCOTUS to intervene & lift a block on the #deportations imposed by a lower court. But a brief filed on behalf of the #immigrants by the #ACLU & #DemocracyForward said that block is now “the only thing” preventing the Trump admin from sending immigrants “to a prison in #ElSalvador, perhaps never to be seen again, without any kind of procedural protection, much less judicial review.”
